PURCHASER AGREES TO THE FOLLOWING:
1. Payments: If the buyer, having put a deposit on a kitten/cat, should later change their mind about the purchase, the deposit will not be refunded. Deposits of US $250 are required to reserve a kitten/cat. ALL DEPOSITS ARE NON-REFUNDABLE. If something life threatening was to happen to the reserved kitten/cat before leaving our care the seller will refund the buyers paid money toward purchase price on contract at that time.
Any balance plus shipping fees is to be paid in full on the kitten/cat 2 weeks prior to leaving for its new home. Payment must clear our bank before buyer can take kitten/cat and before any shipping arrangements can be made.
2. If for any reason you cannot retain ownership of said animal, breeder shall be given the right of first refusal. Under no circumstance will the kitten/cat be sold, leased, or given to any pet shop, animal shelter, research laboratoy, or similiar facility. This remains in effect for the entire life of the kitten/cat.
3. Buyer accepts the responsibility of caring for the kitten/cat and will provide properly for its welfare. The Buyer will never deny the kitten/cat medical/vet treatment. Buyer agrees to keep the kitten/cat indoors at all times in a clean and pleasant environment, not caged, and with proper nutrition, health care (including yearly veterinarian examinations and vaccinations), companionship, and adequate space for exercise. The above kitten/cat is only allowed outdoors while on a leash and while under close supervision. Buyer agrees to provide a suitable warm place for the kitten/cat at all times. Sphynx are more chilled than some other breeds due to the lack of fur. Buyer agrees to provide weekly baths, ear cleanings along with daily eye cleaning (as required).
4. If this cat/kitten is found to be neglected or mistreated, purchaser will surrender said cat/kitten unconditionally without refund of the purchase price. Neglect shall include, but is not limited to: being left alone without human companionship for periods in excess of 24 hours, lack of proper sanitary facilities, being caged, providing poor diet, and poor health. Mistreatment shall include, but is not limited to: lack of proper food, lack of proper medical care, lack of fresh water, and any form of physical abuse.
5. Buyer agrees that this kitten/cat may not be declawed, and understands that declawing is a multation and a cruelty that is likely to alter the kittens temperament and health. Instead of declawing the buyer agrees to keep the kitten/cat's toenails trimmed regularly, and to supply the kitten/cat with proper scratching materials and suitable training.
6. Seller agrees to provide TICA pedigree/registration papers for this kitten/cat purchased as a "breeder" upon picking up/delivery or in a timely manner. The cost of registration is the sole responsibility of the Buyer. Said Registration form/papers for kitten/cats purchased as 'pets' will be marked "NOT FOR BREEDING". If kitten/cat is purchased as a "pet" and not spayed/neutered by the seller prior to being picked up/delivered to the buyer in no form or fashion can the buyer portray said kitten/cat as a registered breeder, or breed the said kitten/cat for profit on any litter. TICA pedigree will not be given to any buyer of a "pet" until said kitten/cat has been spayed/neutered and proof of such from a veterinarian is provided to the seller. It is the buyers responsibility to cover the expense of the said kitten/cat purchased as a "pet" to be neutered/spayed whether it be in the seller/buyers care at that time.
7. Seller agrees to have proper vaccinations for this kitten/cat (age appropriate) and a certificate of health done by our veterinarian before leaving our care. Seller agrees to provide weekly baths, ear cleanings along with daily eye cleaning (as required) while the above kitten/cat is in our care.
8. The kitten/cat is guaranteed to be of sound health upon arrival. Simple Simon Sphynx has a limited warranty guarantee for the above kitten/cat for a period of 72 hours if vet checked within that time. The Buyer must take the kitten/cat to the vet within the first 72 hours while the kitten/cat is still under limited warranty. If the kitten/cat does not visit the vet during this 72 hour warrany period it makes this contract VOID. It is recommended that the above kitten/cat be kept in quarantine during this time. If the kitten/cat above is exposed to other kittens/cats or household pets during the 72 hour warranty period prior to being checked by your veterinarian it makes this contract VOID. If it is found to be medically deficient with untreatable or life threatening illness within the guaranteed time period, buyer must notify the seller immediately with a letter/fax from the examining veterinarian on his/her own personal letterhead stationary. The Seller warranties that the kitten/cat is free of the feline leukemia virus (FeLV) and the feline immunodeficiency virus (FIV) at the time of purchase. Under no circumstance is the kitten/cat to be destroyed prior to notifying the Seller. Buyer will be responsible for ANY veterinary expenses/bills.
If a veterinarian finds the above kitten/cat to have a life-threatening illness or genetic defect related to Simple Simon Sphynx Cattery the kitten/cat may be returned to the Seller. Upon the kitten/cats return with all registration papers, original sales contract, and a written statement from the veterinarian on his/her original letterhead stationary within (48) hours of the defect being diagnosed it will be replaced with another kitten/cat; if one is not available at that time a replacement will be made of comparable quality and value, as available, at the discretion of the breeder(seller). The kitten/cat can't be returned for compensation after the guaranteed period has expired and /or if the the above kitten/cat has been exposed to another kitten/cat/dog or other house pets.
9. The breeder is not responsible for kittens/cats lost or stolen after acceptance by the airline carrier. It is the responsibility of the purchaser to file a claim in the event of loss, injury or death of the kitten/cat.
10. Please note: It is understood that the degree of hairlessness of the Sphynx varies from cat to cat and sometimes from season to season. No Sphynx is truly completely hairless. Hormones, food, temperature, spaying/neutering and/or genetics play an important roll in degree of hairlessness and even though a kitten may be almost hairless when it is sold it is possible that it may develop some hair as it grows. It is impossible to guarantee that any Sphynx kitten/cat will not grow hair at some point in time.
11. Seller cannot guarantee or warranty type, color, behavior/personality, degree of hairlessness, reproductive capability or any show achievements.
12. Seller will keep you informed on the kittten/cat you have put a deposit on up to the date of pick up/delivery in the form of pictures, emails, etc. We want you to be as much involved in the beginning as we are.
13. Kittens/Cats are sold based on the quality the Seller feels the kitten/cat is at the time of sale and is the opinion of the Seller.
14. Buyer of the above kitten/cat gives Simple Simon Sphynx Cattery permission to post any comments/pictures exchanged through emails, written mail, or verbal communication on the Comment Page of our website www.simplesimonsphynx.com, www.simplesimonsphynx.net, www.simplesimonsphynx.org. The Buyer also agrees that they will post SimpleSimon as the kitten/cat's surname whether it be on the computer, website, internet, etc. Example: SimpleSimon_ _ _ _ _ _ _ _.
15. Any legal action which may arise under the terms of this contract will be brought up in Oklahoma, USA. Buyer shall be liable for any court costs and related charges including attorney's fees associated with seller enforcing the terms of this contract. In signing this document, Buyer acknowledges that he/she has read, fully understands, and agrees to ALL of the terms and conditions stated above. The laws of the State Of Oklahoma shall be controlling.
This legally binding contract is the exclusive agreement between the Buyer and Seller and supersedes any and all prior oral or written agreements, negotiations or other dealings between them concerning the purchase and sale of the kitten/cat. This agreement may be modified only in writing, signed by both the Buyer and Seller, and is non-transferable to any other party.
I, the Buyer, have had sufficient time to review and seek explanation of the provisions contained above, have carefully read them, fully understand, and agree to them. I have initialed and dated each page related to this binding contract.
Two (2) copies are made of this contract, one for Buyer, one for Seller.
